E-file mandate

The New York State Department of Taxation and Finance mandates partnership returns, including extensions and Form IT-204-LL) to be electronically filed. Failure to do so could result in significant penalties. For more information, visit https://www.tax.ny.gov/bus/efile/elf_busn_mandate.htm on the New York State website. 

There are numerous credit forms that, if attached to Form IT-204, will require the entire return to be paper filed. See 1065-NY ELF: Forms included in the electronic record for a full list.

Forms included in the e-file

The following types of Form IT-204 can be electronically filed and are automatically included in the electronic XML file:

  • Calendar year returns
  • Fiscal year returns
  • Short year returns
  • Amended returns
  • Extension (Form IT-370-PF for Form IT-204)

Payment options 

Electronically filed Form IT-204-LL must use electronic funds withdrawal (EFW) for any payments. Failure to pay electronically will result in penalties. Form IT-204 (and extension Form IT-370-PF) do not have tax due, therefore payment options are not applicable. Since estimates and penalty forms must be filed on paper, electronic funds withdrawal (EFW) is not possible at this time. A check must be mailed with these forms.

Additional information: New York does not process returns on the weekends. If a return is filed on Friday, it is not uncommon to not receive an acknowledgement until late Monday evening.
